Antonio Felix da Costa has been disqualified from the Misano E-Prix, Round 6, leading to Oliver Rowland of Nissan claiming the victory. The disqualification occurred because the throttle damper spring in car number 13 did not comply with the specifications of one of the three optionally declared elements.

During the process, the team manager and the manufacturer's representative explained that since the start of season 9, they have made no changes to the throttle damper spring. The team manager acknowledged that the sealed part, as shown in the attached technical report, was mounted on car 13 and was sealed in front of the team's head mechanic. He also noted that although changes in the Spark catalog are highlighted, removals are not.

The FIA technical delegate confirmed this procedure and the representatives from Spark clarified that this part was on the list for the GEN2 cars, but not for the current GEN3 ones. They also confirmed that removals from the catalog are neither highlighted nor annulled.

The FIA emphasized that it is the team's responsibility to ensure that the car complies with regulations, according to Article 1.3.3 of the International Sporting Code. Although the part did not provide a performance advantage, the car was required to meet regulations, which resulted in its disqualification and the advancement of the following cars in the ranking.

Porsche has expressed its intention to appeal the decision and has a 96-hour deadline to confirm its appeal.
